The California-based Haitian Bridge Alliance (HBA) has condemned a new asylum rule introduced by the United States Citizenship and Immigration Services (USCIS). The organization warns the policy could speed up deportations while making it harder for vulnerable migrants, including many from the Caribbean, to receive fair hearings.

HBA said the rule allows asylum officers to skip certain procedural steps and send more cases directly into immigration court or removal proceedings. According to the group, the changes are being introduced as a way to reduce the growing asylum backlog. However, Executive Director Guerline Jozef argued that the new process weakens due process protections for people fleeing violence, persecution and instability.

Jozef said the policy raises serious concerns for Haitian migrants, Black migrants and other migrants of colour. She warned that fast-tracking asylum decisions while removing key safeguards could place the lives of people seeking humanitarian protection at greater risk. HBA is urging the Trump administration to withdraw the rule and is also calling on the US Congress to hold hearings to examine its impact. In addition, the organization said it is considering legal action under the Administrative Procedure Act.

The US Department of Homeland Security (DHS), which oversees USCIS, defended the change, saying it is designed to reduce delays in the asylum system. Under the new rule, USCIS can refer asylum applications to immigration judges without first conducting an interview with the applicant. DHS said the previous process often allowed applicants a second opportunity to have their claims reviewed, contributing to a growing backlog.

USCIS Director Joseph Edlow said the asylum system should focus on protecting people with legitimate fears of persecution rather than being used to delay immigration proceedings or obtain work authorization. DHS General Counsel James Percival also said the rule will improve efficiency and strengthen immigration enforcement. The department confirmed that the policy took effect immediately.

The new rule has sparked debate over the balance between improving the efficiency of the asylum system and protecting the legal rights of those seeking refuge in the United States.
