Police Warn Immediate Arrest for Public Smoking
Police in Antigua and Barbuda have issued a strong warning. Anyone smoking in public now risks immediate arrest.
According to Albert Wade, enforcement has already begun. He spoke at Police Headquarters during a press briefing.
Importantly, this move follows changes to the law. The Misuse of Drugs Act was amended in 2024. As a result, officers can no longer issue tickets.
Previously, police could fine offenders on the spot. However, that option has now been removed. Therefore, arrest is the only response.
Wade made the position very clear. There will be no warnings or grace period. Anyone caught smoking in public will be detained.
This rule applies to all substances. It includes cannabis, tobacco, and other controlled drugs. Consequently, all public smoking falls under the same action.
After arrest, offenders must appear in court. Cases will be heard in the Magistrate’s Court. If convicted, they may face a fine of up to $2,000.
Moreover, the crackdown goes beyond individuals. Property owners also face responsibility. If they allow smoking, they may be charged.
Specifically, this applies to public spaces and shared premises. Managers and occupiers must enforce the law. Otherwise, they risk legal trouble.
Wade admitted that public smoking is common. Still, he stressed that the law must be followed. Therefore, police will act despite space challenges.
He also gave direct advice to the public. Simply put, do not smoke in public. If you do, you will be arrested.
Meanwhile, this marks the end of a sensitisation period. Authorities had previously focused on public education. Now, enforcement takes priority.
As a result, citizens must adjust quickly. The shift signals a stricter stance on public behavior.
