Herberts Man Pleads Guilty to Public Cannabis Use
Herberts man has pleaded guilty to smoking cannabis in public. The case was heard before Magistrate Ngaio Emanuel. As a result, sentencing is set for March 30.
The accused, 34-year-old Jamie Darroux, admitted to two charges. These included smoking cannabis in public and possession. He appeared in court on Tuesday after his arrest on Monday.
Following the hearing, the court granted him bail. He was released on his own recognizance. However, he must return for sentencing at the end of the month.
The incident happened on March 23 around 1:30 p.m. Officers from the Narcotics Department were on mobile patrol. During this time, they saw Darroux with others. The group was sitting under a tamarind tree in Potters. The location was near the Registration Unit.
Soon after, officers approached the group. They informed Darroux that smoking cannabis in public is illegal. In response, he handed over the joint. He reportedly asked officers to “give me a break.” He also said they were just relaxing and talking.
After that, officers asked to search him. Darroux agreed to the request. During the search, they found a cashew nut can in his bag. Inside, there was a small transparent bag of cannabis.
Darroux then explained the drugs were for personal use. He stated they were not for sale. Nevertheless, officers seized the cannabis.
The substance weighed 21 grams and was valued at $210. It was later taken to the station. There, it was formally weighed and recorded as evidence.
Meanwhile, the law sets clear limits on cannabis use. Under the Misuse of Drugs Amendment Act 2024, public smoking is illegal. Offenders can face fines up to EC$2,000.
In addition, the law covers many public spaces. These include transport terminals and workplaces. It also applies to restaurants, bars, and clubs. Furthermore, schools and healthcare facilities are included.
Public transport is also covered under the law. This includes taxis, buses, and aircraft. Essentially, any place open to the public is restricted.
Therefore, authorities continue to enforce these rules. The case will conclude when Darroux returns to court on March 30.
