Herberts Man Let Off With Warning After Smoking Cannabis in Public

Herberts man Jamie Darroux appeared in court after smoking cannabis in public. He is 34 years old.

On March 23, Narcotics Department officers saw him under a tamarind tree in Potters. He sat with a small group while smoking cannabis.

When approached, Darroux admitted the offence. “Officer, give me a break and take the drug. We just here chilling,” he said, handing over the joint.

The officers then searched his bag with his consent. They found a cashew nut can containing 21 grams of cannabis valued at $210. This amount exceeded the legal limit for personal possession.

Darroux pleaded guilty to both charges. Consequently, the court fined him $500 for possession. The fine carries 14 days in jail if unpaid.

For smoking cannabis in public, Chief Magistrate Ngaio Emanuel reprimanded and discharged him. She also gave a stern warning, reminding everyone that public cannabis use is illegal.

Under the Misuse of Drugs Amendment Act 2024, public cannabis use can carry fines up to $2,000. The law covers transport, workplaces, restaurants, bars, clubs, government buildings, hospitals, schools, and other public areas.

Moreover, the case highlights officers’ efforts to monitor public spaces. They continue enforcing the law and protecting the community.

Magistrate Emanuel said the warning should guide residents. She stressed that repeat offenders will face stricter penalties.

In addition, the case shows that minor first-time offences may receive leniency. However, citizens must obey the law to avoid fines or imprisonment.
