Captain Willock Secures Third Legal Victory Against ABDF
Captain Javonson Willock has won his third legal battle against the Antigua and Barbuda Defence Force (ABDF).
Earlier today, Justice Rene Williams ruled that the ABDF cannot start disciplinary proceedings. The alleged misconduct dates back to August 14, 2020. Consequently, the ABDF cannot revive those proceedings.
Moreover, the Court struck down the charges issued on December 6, 2024. It declared them unlawful, null, void, and of no effect. This ruling ends the ABDF’s attempt to punish Willock years later.
However, Willock lost part of his claim. The Court dismissed his action for misfeasance in public office. It found no evidence of loss or material damage. Additionally, each party must cover its own legal costs.
Despite the partial setback, Willock remains careful about his next steps. He said he will decide on appealing after reviewing the written decision.
Furthermore, Willock noted, “One of the legs of misfeasance is proving malice or bad faith. The Judge did not say I failed this leg, which is telling.”
The case also sparked controversy. Willock initially sought to remove Justice Williams for apparent bias. He later withdrew the application, allowing the Judge to continue.
During the hearings, the Court reprimanded the ABDF for misleading the judiciary. Lieutenant Colonel Alando Michael wrongly claimed a key witness was in China and unavailable. Willock exposed this error, and the Court recorded it.
Importantly, Willock represented himself throughout the case. Meanwhile, the ABDF used attorneys from the Attorney General’s office and in-house counsel.
Overall, the ruling protects individuals from unlawful disciplinary action. It also stresses the importance of honesty in legal proceedings.
