Belgium court clears path for Mehul Choksi extradition
Belgium has moved closer to extraditing Mehul Choksi to India after a decisive court ruling. The country’s highest court has rejected Choksi’s final attempt to block his surrender, effectively clearing the way for extradition.
Earlier this week, the Court of Cassation dismissed Choksi’s appeal. The court ruled that he failed to present any valid legal or factual grounds to overturn previous extradition orders. As a result, those orders will remain in force.
Choksi, an Antiguan national, has fought extradition for years. However, the court found that his nationality did not affect the case. Instead, judges focused on whether his arguments met the required legal standards. They concluded that they did not.
Indian authorities want Choksi in connection with an alleged large-scale bank fraud. They accuse him of serious financial wrongdoing and have sought his return for several years. During this time, the case has moved through courts in multiple countries.
Throughout the proceedings, Choksi argued that extradition would violate his rights. He also claimed that returning to India would endanger his safety. However, the court rejected these claims. It ruled that they did not meet the legal threshold needed to halt extradition.
Importantly, the ruling exhausts all of Choksi’s legal options in Belgium. He can no longer appeal the decision within the Belgian legal system. Consequently, Belgian authorities are now free to proceed with the extradition process.
For India, the decision marks a significant development. After years of prolonged litigation, the ruling brings the country closer to securing Choksi’s return. Moreover, it strengthens India’s position in pursuing high-profile economic offenders abroad.
The case has been complex and lengthy, involving legal challenges across borders. Nevertheless, Belgium’s decision injects fresh momentum into the process. Officials are now expected to move ahead with procedural steps needed for surrender.
While timelines remain uncertain, the legal barriers have largely fallen away. In effect, Belgium’s top court has delivered a clear verdict. Mehul Choksi now stands closer than ever to facing fraud charges in India.
